If your workplace accident is not your fault and it can be shown that your accident happened because your employer failed to take the necessary steps to protect you then you can make a claim for compensation.
What should I do?
Let your employer know straight away that you have been injured and make sure that the accident is put in the accident book. Get details of any witnesses and keep all relevant paperwork and receipts for any expenses.
When must I claim?
There are some exceptions but generally you have 3 years from the date of the accident to take your claim to court, after that time you will not be able to make a claim. If you are under 18 the 3 years runs from the date you reach your 18th birthday.
How much compensation will I receive?
The amount of compensation you receive depends on various things, on the type of injury you suffered, how long you had your symptoms for and when you are expected to recover. In addition to compensation for injuries you will be able to claim expenses like travel costs, medical bills and loss of earnings where you have not been able to work as a result of the accident.
